Terms of Service

These Terms of Service ("Terms") govern access to and use of the BetterPings platform, website, and API services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

BetterPings provides an API platform that allows businesses to submit limited identity signals such as:

• Name
• Phone number
• Email address
• Geographic indicators

The platform returns enriched identity data and match confidence scoring. BetterPings is intended solely for business and developer use.

You must be at least 18 years old to use the Service. You represent that:

• You have authority to bind the organization you represent
• You will comply with all applicable laws
• You will use the Service only for lawful purposes

Customers are responsible for ensuring that any data submitted to the BetterPings API:

• Was collected lawfully
• Complies with applicable privacy laws
• Complies with marketing regulations
• Complies with consumer protection laws

BetterPings does not verify the legality of data submitted by customers. Customers remain solely responsible for their data collection practices.

BetterPings provides an API that allows customers to send data requests and receive enriched responses. You agree not to:

• Overload or disrupt the API
• Attempt to reverse engineer the service
• Scrape or extract underlying data models
• Attempt to replicate the BetterPings platform
• Bypass authentication or security controls

We reserve the right to implement rate limits, request limits, security monitoring, and API access controls.

BetterPings operates on a credit-based pricing model. Credits may be obtained through:

• Monthly free credits
• Purchased credit packages

Each successful enrichment request consumes one credit. Credits may not be transferred between accounts. Purchased credits do not expire unless otherwise stated.

BetterPings may provide a limited number of free credits to new or existing accounts. Free credits are provided solely to allow customers to evaluate and test the platform.

Free credits:

• May reset periodically
• May expire if unused
• May be modified or discontinued at any time

BetterPings makes no guarantee that free credits will remain available.

BetterPings reserves broad discretion to detect and prevent abuse of the platform. We may suspend, restrict, or terminate accounts if we determine, in our sole discretion, that a user or organization is attempting to circumvent platform limits or policies.

BetterPings may suspend or terminate accounts at any time if:

• The service is used unlawfully
• The service is used in violation of these Terms
• Abuse of the platform is detected
• Payment obligations are not met
• Security risks are identified

We may also terminate or suspend accounts to protect the integrity of the platform or other users.

You may not use BetterPings for:

• Identity theft
• Harassment or stalking
• Discrimination
• Background checks for employment
• Credit eligibility decisions
• Housing eligibility decisions
• Insurance underwriting
• Unlawful marketing activity
• Any use prohibited by law

BetterPings may terminate accounts engaged in prohibited uses.

Customers must comply with all applicable laws including but not limited to:

• Privacy laws
• Marketing laws
• Consumer protection laws
• Data protection laws

Customers are responsible for ensuring that their use of the Service complies with applicable regulations.

All rights, title, and interest in the BetterPings platform including:

• Software
• Algorithms
• Models
• Documentation
• APIs

remain the exclusive property of Higher Ed Growth LLC d/b/a Inquir. Customers receive only a limited license to access and use the Service.

Customers retain ownership of all data submitted to the BetterPings API, including any lead data, identity signals, or related information provided through integrations ("Customer Data").

BetterPings does not claim ownership of Customer Data.

Customer Data is processed solely for the purpose of:

• Providing enrichment responses
• Generating match confidence scoring
• Operating and improving the BetterPings platform

BetterPings does not sell Customer Data submitted through the API.

BetterPings does not use Customer Data to build or resell lead databases or competing marketing products.

BetterPings may temporarily store Customer Data for operational purposes including:

• API processing
• System monitoring
• Fraud detection
• Service improvement

BetterPings may also use aggregated and anonymized system-level data to improve the performance and reliability of the platform. Such aggregated data will not identify any individual customer or consumer.

Customers remain solely responsible for the legality and accuracy of the data they submit to the Service.

Paid credits may be purchased through the BetterPings billing system.

• All payments are non-refundable unless required by law
• BetterPings may change pricing or credit packages at any time
• Customers are responsible for any applicable taxes

You agree to indemnify and hold harmless BetterPings, Higher Ed Growth LLC, Inquir, and their officers, employees, and affiliates from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your misuse of enriched data
• Your violation of applicable laws

BetterPings strives to provide reliable service but does not guarantee uninterrupted availability. We may modify the service, suspend the service, or discontinue features without prior notice.

BetterPings may update these Terms periodically. Updated Terms will be posted on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by the laws of the State of Arizona. Any disputes arising from these Terms shall be resolved in the courts located in Maricopa County, Arizona.
